Terms of Use

These Terms govern use of the Ebb mobile application and this website. By using Ebb, you agree to these Terms. If you do not agree, do not use Ebb.

1. Tide predictions are not safety information

Ebb is not for navigation and must not be used to decide whether water, weather, access, launch, anchoring, swimming, fishing, or boating conditions are safe.

Ebb shows astronomical tide predictions, not observations or real-time water levels. Actual conditions can differ materially because of wind, atmospheric pressure, storm surge, river flow, waves, seiches, bathymetry, dredging, local restrictions, equipment error, and other conditions. A displayed time or height is not a clearance, depth, weather, surf, current, flood, or hazard forecast. Consult official charts, notices, weather and water-level observations, local authorities, and qualified maritime sources before making a safety-critical decision.

2. NOAA source and non-affiliation

Tide predictions and station metadata come from NOAA CO-OPS, a United States public-domain data source. Ebb is independent, is not affiliated with NOAA, and is not endorsed by NOAA or the United States government. NOAA names and station identifiers are used only to identify the source data. Ebb does not use a NOAA seal or imply official status.

3. Availability and cached data

Ebb is designed to retain validated predictions on your device, but uninterrupted access is not guaranteed. Coverage can become stale or exhausted; a station can be changed, retired, unavailable, or corrected; a device can remove local data; and operating-system restrictions can delay notifications. Ebb does not extrapolate beyond downloaded coverage. You are responsible for checking the displayed source, datum, station, time zone, cache status, and coverage before relying on a prediction for ordinary planning.

4. Local alarms

Tide alarms are convenience reminders scheduled from cached predictions. They are not emergency alerts. Delivery can be delayed or suppressed by notification permission, Focus or Do Not Disturb, battery policy, operating-system scheduling, device shutdown, clock changes, or lack of cached events. Do not depend on an Ebb alarm where a missed or late notification could cause injury, loss, or damage.

5. Free and Pro access

The free tier and Pro feature boundaries are described in the app at the time of use. Two products unlock Pro, and both map to the same entitlement:

• Ebb Pro Lifetime is a one-time non-consumable purchase. It does not renew.
• Ebb Pro Annual is an auto-renewing subscription with a period of one year. The price is the localized amount Apple or Google shows on the purchase screen at the time of purchase; Ebb never quotes a price of its own. It renews automatically for a further year, and the store charges your store account at confirmation of purchase and again at each renewal, unless you cancel at least 24 hours before the current period ends. You can cancel or manage it at any time from your Apple or Google account subscription settings, which Ebb also links to from More once the store reports an active subscription. Canceling stops the next renewal; it does not refund the period already paid for.

These Terms and the Privacy Policy are linked from the purchase screen before you buy. The store, not Ebb, controls billing, cancellation, refunds, tax, family sharing, and account rules. Verified Pro access is cached for offline use and is refreshed when the device reconnects.

6. License and acceptable use

Ebb grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for lawful personal purposes. You may not interfere with the service, evade product limits, misuse store systems, introduce malicious code, reverse engineer protected application code except where law expressly permits, or use Ebb to misrepresent NOAA affiliation or official maritime authority.

7. Your device data

Saved places, alarms, display preferences, and tide cache are primarily device-local. Ebb has no user account or cloud backup. A saved-place export contains only an ordered list of NOAA station identifiers; alarms, cache, purchases, preferences, and analytics identifiers are excluded. Losing or wiping the device can therefore remove settings, alarms, and cached data. Read the Privacy Policy for data-handling details.

8. No warranties

To the maximum extent permitted by law, Ebb and its content are provided “as is” and “as available,” without warranties of accuracy, completeness, timeliness, availability, fitness for a particular purpose, merchantability, non-infringement, notification delivery, or uninterrupted operation. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law, Ebb’s operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of use, data, revenue, opportunity, or property; personal injury arising from prohibited safety-critical use; or decisions based on predicted rather than observed conditions. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. This section does not limit liability that law does not allow to be limited.

10. Changes and termination

Ebb may update the app, service, feature limits, or these Terms to improve safety, accuracy, security, legal compliance, or operation. A material Terms change will carry a new effective date. You may stop using Ebb at any time. Ebb may suspend service access for abuse or where operation becomes unlawful or unsafe.

11. Apple App Store addendum

This section applies only to a copy of Ebb obtained from the Apple App Store. It is included so that these Terms serve as Ebb’s custom end-user licence agreement on Apple platforms and contain every term Apple requires of one. Where this section conflicts with another section, this section controls for App Store copies. It does not conflict with, and is subject to, the Apple Media Services Terms and Conditions.

1. Acknowledgement. These Terms are concluded between you and Humoud AlMunawer only, and not with Apple. Humoud AlMunawer, not Apple, is solely responsible for Ebb and its content.
2. Scope of licence. The licence granted to you for Ebb is a non-transferable licence to use Ebb on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that Ebb may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
3. Maintenance and support. Humoud AlMunawer is solely responsible for providing any maintenance and support services for Ebb, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services for Ebb.
4. Warranty. Humoud AlMunawer is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If Ebb fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Ebb to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Ebb, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Humoud AlMunawer.
5. Product claims. Humoud AlMunawer, not Apple, is responsible for addressing any claims by you or any third party relating to Ebb or your possession and use of Ebb, including but not limited to product liability claims, any claim that Ebb fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual property rights. In the event of any third-party claim that Ebb or your possession and use of Ebb infringes that third party’s intellectual property rights, Humoud AlMunawer, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
7. Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer name and address. Ebb is provided by Humoud AlMunawer, B2, S1, Ave 1, H23, Yarmouk 72502, Kuwait. Direct any questions, complaints or claims about Ebb to support@useebb.com.
9. Third-party terms of agreement. You must comply with applicable third-party terms of agreement when using Ebb, including the terms of your mobile data plan and of the app store from which you obtained Ebb.
10. Third-party beneficiary. You and Humoud AlMunawer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of these Terms.

12. Google Play

This section applies only to a copy of Ebb obtained from Google Play. Ebb is provided by Humoud AlMunawer, not by Google, and Google is not a party to these Terms. Your purchase, renewal, cancellation and refund of Ebb Pro are governed by the Google Play Terms of Service and are managed from your Google account. Nothing in these Terms limits any right you have under the Google Play Terms of Service or under applicable consumer law.
